Warranty Policy

Towrex Trailer Warranty Policy

 

Towrex Trailer insists you have read and understand the Towrex Trailers Owner’s Manual. Failure to carry out routine trailer maintenance resulting in trailer and/or component/accessory to fail, is not covered under warranty. https://www.towrex.com.au/owners-manual/

 FOUR (4) Year Warranty

Towrex warrants that each Towrex Trailer and its fabricated steel components, including the main chassis, drawbar, winch post, winch bracket, suspension & guard hangers, C clamps, and wood yokes be free of structural or welding defects for four (4) years from the date of original purchase.

NOTE: The Towrex warranty does not cover misuse, commercial use, or general wear and tear. Towrex does not cover any issues arising from over-loading including but not limited to twisting/bending of chassis or components.

Three (3) Month Warranty

Towrex Warrants that that each Towrex Trailer fitted with the following accessories: trailer hitch coupling, winch, LED lighting, winch, rollers, tefon skids, carpeted bunks, keel guides, u bolts, nuts, bolts, mechanical braking equipment, suspension, fibreglass storage box, EVA foam padding, mud guards, mud flaps, axles, wheel bearings, bearing seals, bearing buddies, wheels & tires, jockey wheels, are fit for their intended purposes for a period of three (3) months from the original purchase date.

NOTE: The Towrex warranty does not cover misuse, commercial use, or general wear and tear. Towrex does not cover any issues arising from over-loading including but not limited to twisting/bending of chassis or components.

Galvanised Surface Warranty

Towrex warrants that each Towrex Trailer and the galvanised accessories and/or components finished and/or coated in hot dipped galvanizing for one (1) year from the date of manufacture on the compliance plate against red rust. NOTE: Towrex warranty does not cover discoloration, fading or oxidization of the galvanised surface or finish.

Powder Coating Warranty

Towrex warrants that each Towrex Trailer and the accessories and/or components finished with a powder coated surface for three (3) months from date of manufacture.

NOTE: Towrex warranty does not cover cracks in paint arising from bolts and/or clamp pressure, cracking in protective coating arising from bolts and/or clamp pressure, flaking or bubbling in/on/around VIN engraving, stone chips, general ware and tear. Towrex warranty does not cover commercial use.

Towrex Trailer Accessories and/or Add-On’s

Towrex Trailer warranty for accessories and/or add-on’s is three (3) months. Examples of products would be Luggage rack, Spare wheel carrier, Lux luggage box, Jerry can holder, Beach launch accessories as a list of examples.

NOTE: The Towrex warranty does not cover misuse, commercial use, or general wear and tear. Towrex does not cover any issues arising from over-loading including but not limited to twisting/bending of components. Standard galvanizing and powder coating warranties still apply.

CONDITIONS AND EXCLUSIONS

  1. All Towrex Trailers & Towrex Trailer components, accessories and fixtures must be returned to your purchasing Towrex Trailer dealer or Towrex Trailer Head Office located in Minto, NSW for review or repairs. Towrex employees will not and can not be expected to travel for Towrex Trailer warranty review or repair process.
  2. Towrex Trailer warranty does not cover the appearance or natural oxidation process of the galvanised surface of any part of the trailer.
  3. Towrex Trailer warranty does not cover rust on any dacromet, powder coated, chrome plated, zinc or painted surfaces of the trailer or any of its components e.g. axles, springs, couplings, winches, bolts / nuts and jockey wheels.
  4. Towrex Trailer is not liable for any damage or defects caused to a hull due to the incorrect adjustment, fitment, supply, hardware or incorrect purpose. Towrex Trailer is not liable for any damage or defects caused to a hull due to incorrect trailer purchase including but not limited to incorrect trailer length or width, trailer layout or fittings/hardware, trailer axle position and/or weight distribution over the trailer or support to boat. Towrex Trailer will act to resolve situations within “reasonable time” at Towrex Trailer discretion. Towrex Trailer will not be held liable for any costs or fees associated with incorrect trailer resolutions.
  5. Towrex Trailer warranty does not cover powder coating chips, cracks, scratches or marks to the paint or powder coating during the fit up of the boat.
  6. Towrex Trailer warranty does not cover general wear & tear of bow rollers, keel roller, roller pins, skids, Teflon surfaces, brake pads, tyres, bearings and or any part of the trailer subject to wear & tear.
  7. Towrex Trailer warranty does not extend to any trailer which is found to have been used for commercial purpose. Found to have been overloaded, altered, and modified from standard.
  8. Towrex Trailer warranty does not extent to any trailers used in/on/for beach launch conditions, situations or locations.
  9. Towrex Trailer warranty does not cover any failures due to lack of routine and/or necessary maintenance.
  10. Towrex Trailer warranty extends ONLY to trailers used on sealed roads & does not extend to any trailer used in/on/for OFF-ROAD conditions, situations or locations.
  11. Towrex Trailer warranty policy for all Electric braked trailers is to follow the components manufactures warranty. Towrex Trailers will not supply, repair and/or replace components without consent from component manufactures. This extends to trailer braking unit, hydraulic lines, hydraulic calipers, electric backing plates and components, and other necessary components required for compliance for trailers over 2 tonne.
  12. Towrex Trailer must provide written authorisation for all warranty work prior to it being undertaken and failure to obtain this written authorisation from Towrex will result in Towrex negating the warranty.
  13. Towrex Trailer is not liable for the transportation costs & charges, or for any direct, special, incidental, accommodation, consequential (including loss of profit) whether based contractually or in tort or arising from a breach of any warranty or otherwise provided that Towrex acknowledges that this warranty does not exclude or limit the application of any Statute (including the Trade Practices Act) where to do so would contravene that Statute or cause any part of this warranty to be void.
  14. Towrex Trailer is not liable or will be held responsible for damaged caused to boat, hull, vessel, craft, watercraft, kayak, canoe, vehicle, motorcycle, quad, ATV, SSV and or any item loaded onto a Towrex Trailer due to incorrect adjustment or fitment, incorrect trailer lay-out and or accessories, misuse or incorrect use, road conditions and or lack of general maintenance resulting in excess wear and tear or failure of trailer and or accessories or components.
  15. Towrex Trailer’s total liability is limited at its option, to repairing or replacing of a trailer with a similar trailer.
  16. Towrex Trailer warranty is subject to Towrex Trailers discretion on all approvals or refusals.
  17. Towrex Trailer reserves the right to investigate all warranty claims by requesting more information not limited to time, dates and any photos that may support customer claims or Towrex’s refusal. Towrex Trailer is not confined to a time frame but ensures to act in a timely manner where possible.
  18. Towrex Trailer has the option to use discretion with the repair or replace any items covered by the above warranties .
  19. Towrex allows the customer two (2) weeks from warranty claim first raised to have the trailer and/or components in question returned to Towrex Trailer purchasing dealer or Towrex Trailer head office for review. Please contact Towrex direct on office land line to have this time extended or agreed to if 2 weeks is not workable with you. Towrex Trailers reserves the right to refuse or agree to extension.
  20. Towrex Trailer warranty covers the original purchaser only and does not extend to next/2nd owner to whom the trailer ownership is transferred.
  21. Towrex Trailer will require proof of purchase via original Tax Invoice & clear photo of compliance plate must be emailed direct to Towrex Trailers when requested. A warranty claim process will not begin until Towrex Trailer has all requested information.
  22. Towrex Trailer is not liable for physical or financial injury, loss or damage or for consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the goods or arising out of negligence or in any way whatsoever. To the extent permitted by the Australian Consumer Law and relevant state legislation, the sole obligation of Towrex Trailer under this agreement is to use its best endeavours to provide the products, or to repair the products, or repair or replace (at Towrex Trailer discretion) any part of a product which is found to be defective during the period of warranty. If the products are supplied to the customer as a “consumer” of goods or services within the meaning of that term in the Australian Consumer Law as amended or relevant state legislation the consumer will have the benefit of certain non-excludable rights and remedies in respect of the products or services and nothing in these terms and conditions excludes or restricts or modifies any condition, warranty, right or remedy which pursuant to the Australian Consumer Law or similar legislation is so conferred. However, if the product is a product not ordinarily acquired for personal, domestic or household use or consumption, pursuant to section 64A of the Australian Consumer Law and similar provisions of relevant state legislation Towrex Trailer limits its liability to payment of an amount equal to the lowest of cost of replacing the goods or supplying equivalent goods; cost of repair of the goods; the cost of having the goods repaired or replaced. Towrex Trailer is not to be liable for default or failure in performance of its obligations pursuant to this agreement resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, accidents, fires, explosions, earthquakes, floods, the elements, strikes, labour disputes, shortage of suitable parts, components, materials, labour or transportation
